These Terms of Service (the "Terms") govern your access to and use of the TrenchFeed API and related services (the "Service"). By registering for an account, using an API key or otherwise accessing the Service, you agree to be legally bound by these Terms on behalf of yourself or the entity you represent. If you do not accept these Terms, you must not access the Service.
We may update or modify these Terms at any time to reflect changes to our business or legal obligations. A terms of service agreement should be flexible and include a process for updating your users; accordingly, we will post the revised Terms with a new "Last Updated" date. Material changes will take effect 30 days after posting. Your continued use of the Service following notice constitutes acceptance of the changes.
You may use the Service only if you are of legal age and have the capacity to form a binding contract. You agree to use the Service solely for lawful purposes and in compliance with all applicable laws, regulations and third‑party rights. You must not interfere with or attempt to circumvent our authentication systems, abuse rate limits, reverse engineer the API, or use the Service to engage in fraud, market manipulation or other prohibited conduct. If you build automated tools based on our data, you must clearly attribute TrenchFeed as the source.
To access the Service you must create an account and generate an API key. You are responsible for all activities that occur under your credentials. You agree to keep your API key confidential, not share it with third parties, and promptly notify us of any unauthorized use. We are not liable for losses caused by your failure to safeguard your account.
The Service, including all underlying technology, data streams, logos and trademarks, is owned by TrenchFeed or its licensors and is protected by intellectual property laws. We grant you a limited, non‑exclusive, non‑transferable license to access and use the data solely for your internal business purposes, subject to these Terms and your subscription. You may not copy, reproduce, distribute, resell, create derivative works from or exploit the data without our express written consent.
Your subscription tier determines your rate limits and permitted uses of the Service. All fees are payable in advance and are non‑refundable except as required by law. We may change our pricing or tiers; we will provide reasonable prior notice of any changes and you may cancel before the new rates apply. You are responsible for any applicable taxes arising from your purchase.
The data provided through the Service is for informational purposes only. While we strive for accuracy and timeliness, we do not guarantee that the data is complete, current or error‑free. The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including any warranties of merchantability, fitness for a particular purpose, title or non‑infringement. You agree that your use of the data is at your sole risk.
A limitation‑of‑liability clause helps reduce exposure by setting boundaries on what users can recover. To the fullest extent permitted by law, TrenchFeed and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, data or goodwill, arising from or related to your use of the Service. Our total aggregate liability for any claim under these Terms will not exceed the greater of one hundred U.S. dollars (US$100) or the amount you paid to TrenchFeed in the twelve‑month period preceding the event giving rise to the claim.
You will indemnify, defend and hold harmless TrenchFeed and its officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms or your violation of any rights of another.
The Service may include links to third‑party websites or services. We do not control or endorse third‑party content and are not responsible for its availability, accuracy or reliability. A third‑party links clause makes clear that you are not liable for content on external pages; your interactions with third parties are solely between you and the third party.
We may suspend or terminate your access to the Service at any time, with or without cause, including if you breach these Terms, exceed rate limits, or misuse the API. Upon termination all licenses granted to you end immediately and you must cease using the Service and delete any cached data except as permitted under a separate written agreement.
These Terms are governed by and will be construed in accordance with the laws of the United States of America. Any dispute arising from or relating to these Terms or the Service will be resolved through binding arbitration administered by the American Arbitration Association, except that either party may bring a claim in small‑claims court. The arbitration will be conducted in English before a single arbitrator. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
These Terms constitute the entire agreement between you and TrenchFeed regarding the Service and supersede all prior agreements. If any provision is found to be unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. You may not assign these Terms or any rights or obligations hereunder without our prior written consent.
